Aliens: Colonial Marines Lawsuit to Move Forward
It now appears Sega has another legal mess on its hands. After having witnessed Archie brought to its knees by Ken Penders over the Sonic comics and preparing now for a related case with Penders over Sonic Chronicles, Sega will have to appear in court with Gearbox to answer to a class action lawsuit seeking damages for alleged false advertising of Aliens: Colonial Marines.
According to a report from Sega Addicts, a motion to dismiss the case filed by both companies against plaintiff Damion Perrine was ruled invalid. It means the lawsuit will continue forward, and that lawyers for both plaintiff and defendant are scheduled to appear in court next week.
Companies tend to want to settle suits like this as quickly and efficiently as possible. Sega may especially want to put this behind them, given recent layoffs at Sega of America that could foretell another shaky fiscal quarter to come. Assuming a settlement, anything from a public acknowledgement of A:CM’s shoddy quality to consumers receiving a partial refund could be in the cards.
